The main issue of Italian sportsbetting regulations currently is that operators are allowed to offer only events and types of bets included in the official list issued by AAMS (the so called “palinsesto“), but this is going to change shortly as a consequence of a draft decree now notified to the European Commission.
The draft decree allows operators to offer both events different from those included in the palinsesto and types of bet relating to events included in the palinsesto but for which the palinsesto does not prescribe that type of bet and – unlike what ordinarily currently happens – prescribes that the operators themselves will certify the results of customised bets. In order to be approved to the offering of customised bets, operators shall submit to AAMS a technical document showing how they plan to certify events, pass a technical test and – in relation to each customised bets/types of bet – submit to AAMS the documentation describing it. Finally operators shall pay an additional gaming duty of 0.5% of the turnover generated by customized bets (on the top of the current taxation) as consideration for the administrative costs necessary for their management.
The major advantage of such decree will be that the competition among operators will not be limited anymore to the mere offering of the best odds, but will be extended to the events/types of bets so helping operators whose success is also based on their creative events/types of bets. However, it is worth it to mention that the authorizations required and the higher taxation may be a disincentive to their offering.
The European Commission will review the draft decree for 3 months and – if no comments are raised by the EU Member States and the EU Commission – the final version of the decree is likely to be adopted shortly after that.
