With considerable delays, the E-Cookies Directive 2009/136 has been finally implemented setting the rules on cookies in Italy with some better news than expected but also some gaming law concerns for operators.
The principle is the same, it is necessary the prior opt-in (i.e. the previous consent) to the collection of information through cookies in Italy on users’ computers or the access to the information already stored therein.
However, the Italian Data Protection Authority is supposed to issue guidelines on “simplified” privacy policy and in order to give the consent it will be possible to use specific settings of software programs and devices that can be easily managed by users.
What are the consequences for the gaming sector that relies so much on cookies? Performance of regulatory obligations – e.g. money laundering data retention obligations – through cookies is not affected by these new restrictions. However further monitoring activity – e.g. those aimed for marketing purposes and also those performed for fraud detection purposes – might be affected.
The law on cookies in Italy is already into force and this means that applicable fines and possibly criminal penalties might already be issued.
