The Italian Communications Authority (AGCOM) launched a public consultation on the new draft regulations on the authorization process for transferring the ownership of broadcasters, including network operators or companies (or lines of business) holding media services authorizations.
The new draft regulation aims at simplifying the process, setting up a single step for the identification of the relevant market, including the finding of positions that are dominant or leading pluralism, and for issuing the measures provided by the Audiovisual Services Unified Act.
AGCOM finally clarifies, among others, that the prior notification is requested only in case both anti-concentration thresholds are attained (namely Euro 48 million for the target and Euro 482 million for the parties involved). This should reduce the number of prior notifications, in line with what previously set out also for the Antitrust Authority.
