As of September 27, 2021, only the new (no longer the old version) version of the Standard Contractual Clauses approved by the European Commission can be used to govern personal data transfers outside the European Economic Area.ย DLA Piper Law Firm’s legal design experts, Deborah Paracchini and Enila Elezi, created the infographic below to support companies in using the new Standard Contractual Clauses, which is far more complex than it was with the previous version of the SCCs.
A key element of the new Standard Contractual Clauses is the express reference to the data transfers assessment following the Schrems II case.
